I would have to say 90% of turbo mr2s in Australia are running some form of cold air intake system myself included,so it would depend on the poe poe that's is trying to defect you...most don't even know where the engine is located.

Yes, in my opinion, a replacement K&N flatbed filter Part No. 33-2030 is your best option (in the original air filter box).
From my experience, if your looking at installing one of the 'Pod' style types, irrelevant of brand, ensure it is properly secured, not flopping around.  If it is not, that's normally why they often get 'Defected' from our friends in blue.

I've got an original flat style K&N Filter (For OEM Airbox) that I'm willing to sell if your chasing one? Just flick me a PM.

If its just the air filter, then yes totally legal. If your replacing it with a new cold pipe which then generally uses the cone style filter, then you'd probably need to get it checked to be 100% legal. (Certainly in WA anyway)

I have seen the police use cars that have pod filters in them. They are enclosed in the factory air box, so the defect they hand out is 'use unenclosed pod filter' or a defect related to the way it has been mounted.
